Administrative Order No: 2018–1.1

In Re:

Order Terminating the Residential Mortgage Mediation
Program (RMM Program) and Vacating Administrative Order No. 2016-5.1

Whereas, the number of residential foreclosure cases filed in the circuit has been reduced and the need for a court-ordered program substantially diminished; and

Whereas, it is no longer economically feasible to sustain the Residential Mortgage Mediation Program, the Program Manager, and related administrative and logistical support;

Now, Therefore, it is Ordered:

  1. Effective March 16, 2018 the Twelfth Judicial Circuit Residential Mortgage Mediation Program is Terminated and Administrative Order No. 2016-5.1 is Vacated.
  2. The Program Manager shall decline to accept new cases for mediation as of the date of this order and shall use its best efforts to notify the most active servicers or lenders of the program’s termination.
  3. Parties whose cases are pending residential foreclosure mediation shall be promptly notified in writing by the Program Manager that their mediation conferences shall be concluded on or before March 16, 2018. After that date there will be no administrative support by the Program Manager or the court.
  4. As authorized by the Rules of Civil Procedure, parties interested in engaging in foreclosure mediation may apply to the assigned civil division judge for an order of referral to mediation.
