Administrative Order No: 2018–3.2

In Re:

Sheriffs as Officers of the Court

Pursuant to the power vested in the Chief Judge under article V, section 2(d), Florida Constitution, and section 43.26, Florida Statutes, which empowers the Chief Judge “[t]o do everything necessary to promote the prompt and efficient administration of justice in the courts .... ”; and

Pursuant to Florida Rule of Judicial Administration 2.21S(b)(2), which requires the Chief Judge to “direct the formation and implementation of policies and priorities for the operations of all courts and officers within the circuit”; and

Pursuant to the authority of the Chief Judge recognized in the Second District Court of Appeal decision In re: Thomas M. Knight, Sheriff of Sarasota v. Chief Judge of Florida's Twelfth Judicial Circuit, et. al. (Case No. 2D17-965); and

Pursuant to section 26.49, Florida Statutes (2017), which states “[t]he sheriff of the county shall be the executive officer of the circuit court of the county; and

Pursuant to section 34.07, Florida Statutes (2017), which states that the sheriff is also the executive officer of the county court, it is therefore

Ordered that the Sheriffs of Desoto, Manatee and Sarasota counties as well as their deputies and others employed by, or under contract with, and under the direction of, these agencies, when abiding or following the directions of the Chief Judge to promote the prompt and efficient administration of justice in the courts, including but not limited to the security of court facilities, are deemed to be acting as officers of the court.
