Administrative Order No: 2018–4.12

In Re:

Authorizing Local Law Enforcement Agencies
Within the Twelfth Judicial Circuit to Effect Service
of Domestic Violence Injunctions Pursuant to §741.30, Florida Statutes

Whereas, pursuant to the power vested in the chief judge under article V, section 2(d), Florida Constitution, and section 43.26, Florida Statutes, which empowers the Chief Judge “[t]o do everything necessary to promote the prompt and efficient administration of justice in the courts … ”; and

Whereas, pursuant to Rule 2.215(b)(2), Florida Rules of Judicial Administration, which requires the Chief Judge to “ … direct the formation and implementation of policies and priorities for the operations of all courts and officers within the circuit”; and

Whereas, pursuant to section 741.30(8)(a)1, Florida Statues, the chief judge “may authorize a law enforcement agency within the jurisdiction to effect service” of domestic violence injunctions after consultation with the appropriate sheriff; and

Whereas, in order to improve the administration of justice within the Twelfth Judicial Circuit, it is hereby

Ordered that effective immediately, all local law enforcement agencies within the Twelfth Judicial Circuit that are approved by the county sheriff after consultation with the requesting agency are authorized to effect service pursuant 741.30(8)(a)1, Florida Statutes. Approval by the sheriff shall be in writing with a copy sent to the Chief Judge referencing this administrative order. All approved law enforcement agencies serving domestic violence injunctions pursuant to section 741.30(8)(a)1, Florida Statutes, shall use service and verification procedures consistent with those of their county sheriff.

A sheriff may rescind a law enforcement agency’s approval to serve domestic violence injunctions at any time. If a sheriff rescinds the approval to effect service from a previously approved law enforcement agency, the recision shall be in writing with a copy sent to the Chief Judge referencing this administrative order.

Copies of all letters received from sheriffs approving or rescinding approval from a local law enforcement agency to effect service of domestic violence injunctions will be added to the end of this administrative order and published on the court's website when received.
