In the Circuit Court of the Twelfth Judicial Circuit in and for
DeSoto, Manatee and Sarasota counties, Florida

Administrative Order No: 2019–6.1

Whereas, eviction cases and mortgage foreclosure actions may involve orders for rent to be paid into the court registry during the pendency of the action; and

Whereas, the clerks’ offices have eviction and mortgage foreclosure cases with outstanding rents on deposit from cases that have been disposed of by Order of Dismissal and Notice of Voluntary Dismissal; and

Whereas, the Clerks of Court in Desoto, Manatee and Sarasota County are still in possession of funds deposited as rent in disposed cases where no request was made for disbursement of these funds;

Now, Therefore, it is Ordered and Adjudged that:

In eviction and mortgage foreclosure cases that have been closed by Order of Dismissal or Notice of Voluntary Dismissal, where no request was made for disbursement of rent deposits within 30 days of disposition, the Desoto, Manatee and Sarasota County Clerks of the Circuit Court are authorized to release the deposit to the respective depositor.
