Administrative Order No. 2023–24.12

Due to the recent creation of a full-time civil magistrate position in Manatee County, all Orders of Referral to General Magistrate entered prior to December 20, 2023, which specifically named David Caskey as the presiding general magistrate in family division cases pursuant to Florida Family Law Rule of Procedure 12.490(b)(3), may be heard by a different general magistrate.

Effective January 2, 2024, General Magistrate David Caskey is assigned to Manatee Circuit Civil Divisions B and D, while General Magistrate Vincent A. Giura is assigned to Family Division 4 in Manatee County.

Pursuant to the power vested in the Chief Judge under Article V, Section 2(d), Florida Constitution, Section 43.26, Florida Statutes (2023), and Florida Rule of General Practice and Judicial Administration 2.215, and to improve the administration of justice within the Twelfth Judicial Circuit, it is

Ordered that effective December 20, 2023, all cases previously referred to General Magistrate David Caskey are now referred and assigned to General Magistrate Vincent A. Giura in accordance with Fla. Fam. L. R. P. 12.490(b), excluding the limited cases already partially heard by Magistrate Caskey and requiring additional hearing time to determine their resolution, as well as during times in which Florida Judicial College is scheduled. These cases will be identified and coordinated by Magistrate Caskey’s office.

Any party objecting to Magistrate Giura hearing their case as a general magistrate shall adhere to the time limitations specifically outlined in Fla. Fam. L. R. P. 12.490(b) and consent shall be deemed provided expressly and/or impliedly following expiration of this timeframe (i.e., within ten days of December 20, 2023).
