In Re:
Assignment of Court Clerks
for Court Proceedings
On March 1, 2005, this court entered Administrative Order 2005-03.2, which gave direction regarding assignment of court clerks for various proceedings. Since that time, numerous rule and statutory changes have been made. It is therefore necessary to update that Administrative Order.
Pursuant to Florida Rules of General Practice and Judicial Administration 2.215(b)(6), and section 43.26(2)(d), Florida Statutes, the Chief Judge may require the attendance of state attorneys, public defenders, clerks, bailiffs, and all other officers of the court.
It is, accordingly, ordered:
Effective immediately, court clerks (as designated, selected, and assigned by the respective Clerk of Court for each county) will be present in all court proceedings to assist all circuit judges, county judges, magistrates, and hearing officers.
Individual judges, magistrates, or hearing officers may opt out of this requirement with prior notice to, and the approval of the Chief Judge.
Administrative Order 2005-03.2 is superseded by this order, effective immediately.
